Station in New York, which arrived at 6:15 pm and then proceeded to a subway train. He entered the second car from the front and rode on the train to Time Square where he got out and proceeded towards the S train. Defendant Officer Danoy stopped and arrested Plaintiff and handcuffed him on the belief that he had sexually abused a fellow train passenger. \n\nDefendant Officer Trotter reported that he witnessed Plaintiff following the alleged victim of sexual abuse, followed the victim into the subway car she chose, and then stood directly behind her and thrusted his hips back and forth into the buttocks of the victim. Upon arrival at Times Square, Defendant Trotter testified that he approached the victim and asked her whether anything occurred. However, Defendant Trotter's accounts were false and not sufficient to support charges or arrest of Plaintiff. They were not consistent with the train schedules and no surveillance footage was every recovered to support it. Plaintiff responded by asking Lu why he was being told to leave, and cited MTA rules expressly allowing artistic performances on MTA property. After an exchange between the two lasting not more than 45 seconds, Lu informed plaintiff that he was being placed under arrest. Lu directed defendant Tavares, another officer on the scene, to arrest plaintiff in the middle of the Mezzanine platform, as dozens of onlookers and passersby watched. After plaintiff was placed in handcuffs, Tavares searched plaintiff's effects and person. Tavares damaged plaintiff's property in the process of searching, specifically an antique briefcase that was part of plaintiff's artistic performance. Plaintiff was taken to the 14th Precinct, where he was held in custody until approximately 4 a.m., at which time he was released on his own recognizance after signing a Desk Appearance Ticket and agreeing to appear and answer to the charges against him.
