She complied, and Defendants told her that they believed she was intoxicated. Plaintiff explained that she was the designated driver and had not consumed any alcohol. Nonetheless, Plaintiff was immediately placed in handcuffs without being administered a breathalyzer exam. When the plaintiff yelled to her family to go home to avoid trouble, one of the defendants, a female officer, told her to \"shut up\" and administered pepper spray to her face. Plaintiff was pepper sprayed with her hands cuffed behind her back in the back of a police vehicle with all of the windows closed. She begged the officers to open a window and they refused. When she asked why she was being arrested, she was given no response. When they arrived at the precinct, the defendants dragged Plaintiff out of the car by her handcuffs. Her eyes were swollen shut and she collapsed on the floor while begging to be taken to the bathroom to wash her eyes. The defendants ignored her. She was later taken to the hospital via ambulance, where she was handcuffed to the bed for about 10 hours. No one requested to take blood from Plaintiff while she was in the hospital to determine whether she had in fact consumed alcohol. Plaintiff was ultimately released from the hospital, taken to central booking, arraigned and released. All charged against her were dropped.","documents":[{"url":"https://storage.courtlistener.com/recap/gov.uscourts.nysd.437597/gov.uscourts.nysd.437597.25.0.pdf","type":"complaint"}],"url":"https://www.courtlistener.com/docket/4523044/gonzalez-v-the-city-of-new-york/"}],"discipline":[{"case_no":"2013-10071","disposition_date":"2015-02-19","penalty":"Forfeiture of five (5) vacation days","opened_date":"2013-07-25","charges":[{"desc":"Did abuse his authority in that office searched vehicle of person known to the Department without sufficient legal authority","disposition":"Guilty"}],"documents":[{"name":"Document","url":"https://www.documentcloud.org/documents/4419015-nypd-cases-347.html"}]}],"documents":[{"url":"https://www.documentcloud.org/documents/22119144-930504_02192015_2015080pdf","date":"2015-02-19T00:00:00.000Z","type":"trial-decision"},{"url":"https://www.documentcloud.org/documents/24441170-bronx-notified-officers-list-edited_redacted-redacted_redacted","type":"credibility-finding"},{"url":"https://www.documentcloud.org/documents/21015521-daf-kraft930504","type":"brady-giglio"},{"url":"https://www.documentcloud.org/documents/21015517-df-kraft930504","type":"brady-giglio"}],"id":"EDKH","url":"https://www.50-a.org/officer/EDKH"}
