Plaintiffs Richard Moreno, Jonathan Reyes, Rafael Robles, and Jaime Vega were passengers in the vehicle. Rivera's vehicle was pulled over by a police van and Defendant Officer Derek Bruno approached the vehicle and stated they were being pulled over for having tinted windows. He then asked for Plaintiff Rivera's license and registration and Rivera complied. Defendant Bruno left the vehicle in order to verify the registration and a female officer approached. In an abusive tone, she directed Plaintiff Rivera to keep his window rolled down. When Rivera objected due to the cold temperature, the aforementioned officer opened the driver's side door and demanded, using profanities, that the Defendant get out of the car. Defendant Rivera was then placed in handcuffs and searched. A female officer then used a handheld \"tint meter\" device to check the light transmittance of the vehicle's windows. It was apparent that the tint meter was malfunctioning, as the officer took multiple readings of each window and frequently struck the device with her hand.\n\nAs Rivera was removed from the vehicle, Defendant Sergeant Adonis Ramirez approached the passenger side and began questioning the passengers. Plaintiffs Moreno, Reyes, Rivera, Robles, and Vega remained silent in the face of the questioning. In response, Defendant Ramirez exclaimed \"Oh you're going to ignore me? Get the f**k out of the car.\" The Plaintiffs were removed from the vehicle, placed in cuffs, and searched. Then all five were placed in a police vehicle and transported to the 52nd Precinct. Plaintiff Rivera was held and processed at the 52nd Precinct and was released later that day and issued four Desk Appearance Tickets by Defendant Derek Bruno for the alleged VTL violation of having tinted windows. On September 1, 2014, Plaintiff Rivera was acquitted of all charges. Plaintiff Reyes was released later that day and issued a summons for Disorderly Conduct by Defendant Bruno, with an arraignment date of February 20th, 2014. All charges against Reyes were dismissed at his February 20, 2015 hearing. Plaintiffs Moreno, Robles, and Vega were held and processed at the 52nd Precinct and were then transported to Bronx Central Booking. They were detained there for approximately 20 hours. Plaintiffs Moreno, Robles, and Vega were arraigned on December 1, 2013. All three accepted Adjournments in Contemplation of Dismissal and were released.
