Plaintiff was arrested for obstruction of government administration. His brother was also arrested. Plaintiff did nothing to interfere with police arresting his brother. Also, defendant police claimed he was drinking and smelled like alcohol, but he was sober. The officers used undue force upon Plaintiff when placing him under arrest. The defendant officer placed handcuffs unnecessarily tight, then pulled his arms up and away from his body, causing extreme pain. When Plaintiff asked them to stop, defendant officers demanded Mr. Moghraby say “I’m sorry” before he would stop assaulting him. The officers’ lack of evidence and fabrication of evidence resulted in Plaintiff's incarceration for over 17 hours. He also missed a day of work because of the arrest and was not compensated for it. At arraignment Plaintiff received an Adjournment in Contemplation of Dismissal (“ACD”). No members of the group owned or could move the car. Shortly after the owner arrived and stated to POs he was the owner of the car. The owner was given a ticket and the owner, in an apparent moment of frustration, let the ticket drop to the ground. As he attempted to retrieve the ticket PO Benloussin and another pushed the owner against the car and arrested him. Other POs shortly arrived at the scene. Plaintiff attempted to leave to get a drink at a corner store and as he was leaving heard a PO say \"arrest him too.\" Plaintiff did not know POs were talking about him as he was not looking in their direction. \n\nPlaintiff made it as far as his neighbor's house when POs violently grabbed Plaintiff, pushed him into a fence, and applied a choke hold on Plaintiff until he collapsed. Plaintiff was then pushed to the ground and held there by two officers, one with his knee on Plaintiff's back and one holding his arms. As Plaintiff was being handcuffed and not resisting a third officer put his foot on the side of Plaintiff's face and violently smashed Plaintiff's head into the concrete sidewalk. Plaintiff was then pulled to his feet via his handcuffed arms, verbally abused, shoved into the side of a police car, then transported to the 81st Precinct and Central Booking. Plaintiff requested medical attention for his head and his hands, which were cut due to excessive force in apply handcuffs. POs refused to provide Plaintiff with medical treatment. PO Benlhoussain falsely filed charges of assaulting a PO, obstruction, and disorderly conduct against Plaintiff. Plaintiff was released approximately 20 hours later without formally being charged with any crime and without being presented before a judge.
