Plaintiff complied, and then Defendant officers placed excessively tight handcuffs on Plaintiff without justification. The search yielded no contraband, but Defendant Officers falsely arrested Plaintiff with possession of a controlled substance and sale of a controlled substance to others. Plaintiff was transported to the 46th precinct. Due to pregnancy, Plaintiff was dehydrated and required medical assistance during transport, but her requests were denied. Plaintiff asked for medical attention again when she arrived at the precinct, but her request was denied. Her request for water was also denied. Plaintiff was held in a cell for 3 hours before being taken to Central Booking, where she was examined by an EMS attendant. Plaintiff complained that she had lower back pains and that she was pregnant. No further medical assistance was provided to plaintiff. Because Plaintiff walked out of the same building that an alleged drug suspect exited, Defendant Brown forwarded the false arrest information to prosecutors to initiate a malicious prosecution. Plaintiff was incarcerated for 29 hours, until she was released on May 23, 2018 at 7:00 PM. Frias was also applied excessively tight handcuff, causing him contusions and severe pain. Furthermore, despite being strip searched, nothing relevant was found. The officers then maliciously prosecuted Frias and knowingly provided false evidence as to the conversation between Frias and Humphrey despite knowing Frias's innocence in order to inflict harm on Frias and further collateral purpose. Other officers also failed to intervene despite having a duty to do so. Charge against Cristomo was ultimately dismissed and terminated favorably for him. P.O.s provided false information to the D.A.’s office alleging that Plaintiff sold crack-cocaine and resisted arrest. Plaintiff was incarcerated for approximately 23 hours before being released.
