Defendant Checo, along with defendant NYPD officers Moises Garcia (Shield No. 5782) and Thomas Warkenthien (Shield No. 3876) then chased plaintiff down the street. Defendant Checo then exited his vehicle and drew his gun on plaintiff, noting that he would shoot plaintiff to stop him. Defendants Checo, Garcia and Wakenthien then tackled plaintiff to the ground, punched him, kicked him, beat him and handcuffed him. One of these three defendants put his knee on the top side of plaintiff's face, pressing it into the ground. Plaintiff was taken to a local precinct and processed, and was denied medical care by defendant NYPD sergeant Stephen Monroe (Shield No, 2330). Plaintiff was eventually taken to a hospital. Plaintiff suffered severe injuries as a result of this incident. Defendants proceeded to maliciously prosecute plaintiff despite knowledge that he had committed no crime. NYPD officers knocked and demanded entry.  When Plaintiff Echevarria demurred, the officers grabbed him through the partially opened door.  There they slammed Plaintiff Echevarria against a wall and cuffed him.  When Plaintiff Martin asked what was going on she was told there were complaints about Plaintiff’s throwing garbage out of the windows, despite Plaintiff Martin showing the bags being assembled to take garbage out.  The officers then conducted an illegal, warrantless search of the apartment.  When Plaintiff Martin objected to their illegal conduct, Defendant Officer Mack ordered Defendant Officer Monroe to arrest her.  Plaintiffs were kept in the hall while the illegal search proceeded.  The Defendant Officers took about $18,000 in cash from the apartment.  After Plaintiffs were taken to the 40th Precinct, they were illegally questioned about the money after Plaintiffs had demanded counsel per Miranda.  Plaintiffs were eventually released after about 24 hours with no charges being filed.
