When the cashier called the police, Plaintiff left the store and waited outside with his pedicab. Officer Scott Carley and another officer arrived on the scene. As an immigrant of Moroccan descent, Plaintiff explained the situation to Officer Carley with an Arabic accent. After Officer Carley's cursory investigation of the situation, Officer Carley sided with the cashier and would not help Plaintiff any further. Plaintiff was unhappy and expressed his dissatisfaction. He did not yell or scream or cause a disturbance in any way. Without warning, Officer Carley threw Plaintiff down and stomped on his foot, thereby breaking Plaintiff's foot. After staying with Plaintiff overnight at the hospital, Officer Carley falsely arrested and charged Plaintiff for disorderly conduct and resisting arrest to cover up his own unconstitutional acts. Officer Carley attacked Plaintiff, falsely arrested him, and falsely charged him with crimes because Plaintiff is Arabic and of Moroccan origin. On August 1, 2022, the court dismissed all charges against Plaintiff. Several minutes before, the same officers issued plaintiff a summons for, upon information and belief, windows excessively tinted. In an exercise of his First Amendment rights, plaintiff displayed his middle finger to defendant officer Armani. The defendants approached the plaintiff while plaintiff was video-recording on his cell phone. Armani asked the plaintiff for his identification, objected to plaintiff's gesture, grabbed and immobilized plaintiff's left hand, and grabbed plaintiff's cell phone from his right hand. Armani again demanded identification, which the plaintiff had left in his car. Defendants Armani and Cybulski then lifted plaintiff to his feet and handcuffed him. The other police officers (Mendez, Carley, Khamis, and Farrar) stood close by and failed to intervene in the illegal actions of Armani and Cybulski. All the defendant officers brought plaintiff to a nearby NYPD patrol car. \n\nPlaintiff demonstrated full physical compliance as the arrest was happening, but he was charged with a misdemeanor Crime of Resisting Arrest and Disorderly Conduct based on Cybulski's perjurious sworn statement. Defendants Armani and Cybulski falsely arrested the plaintiff and maliciously initiated, commenced, and continued a prosecution against plaintiff. The charges against the plaintiff were dismissed after multiple court appearances across approximately four months. Defendants Armani and Cybulski also exercised an objectively unreasonable use of force against the plaintiff and deprived plaintiff of his constitutional rights by preventing plaintiff from filming police activity, destroying video evidence, fabricating evidence, and abusing criminal process.
