Plaintiff is a young, black man; and the other three occupants of the car were also young, black men. They were stopped by Jones and Santomero in the vicinity of Paulding Ave and E. 214th St. in the Bronx. Jones ordered the driver to step out of the vehicle. Welton and other officers arrived at the scene. Jones told the driver he did not intend to issue the driver a speeding ticket and was only looking for guns and drugs. Plaintiff began recording the officer standing by his window and asked the officer to identify himself. Officers became aggressive and demanded occupants exit the vehicle. Plaintiff told one of the officers he was scared and did not want to exit the vehicle given the history of such encounters turning deadly for young, black men in his position. Officers dragged Plaintiff and the other occupants out of the vehicle. Walton illegally seized Plaintiff’s cell phone. Plaintiff was searched, placed in handcuffs, and transported to the 47th Precinct. Defendant officers searched the vehicle without a warrant but there was no contraband in the vehicle. Plaintiff was taken to Central Booking. Jones prepared an arrest report that falsely accused Plaintiff of a Class A Misdemeanor. The DA declined to prosecute Plaintiff because there was no evidence he prevented the officers from issuing the driver a summons for speeding. On March 10, 2019, Plaintiff was released from custody.
