The plaintiff was waiting in line outside a funeral home for a friend's service when he noticed a commotion involving civilians and officers across the street. He began recording the interaction with his phone while standing on the curb. Without warning, five officers approached and began pushing and punching him in the head and face, causing him to fall. The defendants continued to slam him into the ground, kick him in the abdomen, and punch him, causing bleeding. He was arrested with excessively tight handcuffs despite not resisting and was searched with no contraband found.\n\nAfter the arrest, the plaintiff was taken to the 25th precinct, detained in a holding cell, then transferred to Manhattan Central Booking where he was fingerprinted, photographed, given a retinal scan, and held. He was taken to a hospital for his injuries, then returned to Manhattan Central Booking and detained for about 20 hours. The defendants falsely accused him of resisting arrest, criminal possession of a weapon, and menacing an officer. He was detained for approximately 24 hours until his arraignment in criminal court, charged with crimes he did not commit, and released on his own recognizance. All charges were dismissed in his favor on March 29, 2021.
