Plaintiff did not steal any property or commit any offenses under city or state laws that would support his arrest. Defendant officers tightly handcuffed plaintiff behind his back, pushed him into their police cruiser, and detained him at the NYPD's 81st precinct for an extended period. Prosecutors commenced proceedings against plaintiff based on false statements made to them by the defendant officers. Plaintiff could not make bail and, as a result, was detained at Rikers for six months until the charges against him were dismissed on March 5, 2013. While at Rikers, on October 16, 2012, plaintiff was assaulted by another incarcerated person who had a known history of assaultive behavior. Defendant corrections officers, including but not limited to defendant CO Newkirk, stood by and watched the assault but did not call for or administer help until plaintiff had already been severely wounded.
