Defendant officers asked for Plaintiff's ID, which he provided, and asked Plaintiff to exit the vehicle, which he did. Subsequently, defendant officers seized Plaintiff and conducted an illegal search of his person without probable cause. Defendant officers accused Plaintiff of a criminal offense and forced his arms behind him in order to put excessively tightened handcuffs on him. Plaintiff complained about the tight handcuffs but was ignored. Plaintiff was transported to the 43rd precinct where he was fingerprinted, searched, photographed, and interrogated without counsel. Plaintiff remained in a holding cell at the precinct for approximately 4 hours. Officer Polanco then filed a criminal court summons against Plaintiff in Bronx Criminal Court accusing Plaintiff of possession of marijuana and possession of a weapon.
