After stopping to drop off his cousin at the aforementioned location, Plaintiff was stopped by Defendant NYPD officers JAMES TALBERT, and JOHN or JANE DOE 1-10 in an unmarked car and accused of illegally double parking. Plaintiff exited his vehicle in an attempt to explain to the officers that he was just dropping off his cousin. Against Plaintiff's protest the officers conducted a search of Plaintiff's vehicle without probable cause. When Plaintiff repeated his protest, he was violently thrust backwards by the officers, slammed into the back of a vehicle, and assaulted. The officers punched and kicked Plaintiff causing him injuries including a black eye, lacerations, a torn ulnar collateral ligament and severe emotional distress. Plaintiff was then arrested for resisting arrest, tightly handcuffed and transported to the 44th precinct where he was subjected to a strip search with attendant cavity inspection. Plaintiff was detained for approximately 24 hours before being arraigned and released on October 17 with a DAT.
