The POs stopped, detained, and questioned Plaintiff as to why he was wearing a bulletproof vest. Plaintiff responded that he was wearing it for protection from bodily harm due to the presence of gun violence affecting people of his skin color. The POs continued to detain Plaintiff and then questioned him about documentation marked with a legitimate court seal that was lawfully posted on the back of Plaintiff's vehicle, accusing him of Criminal Possession of a Forged Instrument. The POs then reached out to grab Plaintiff. Plaintiff offered exculpatory evidence regarding the documentation, which was in fact evidence of two prior incidents where he was falsely arrested under similar circumstances. The POs ignored Plaintiff and handcuffed his wrists behind his back with excessively tight cuffs, aggravating a pre-existing shoulder injury.\nThe POs then searched him without warrant or probable cause, then transported him to the precinct, where he was unlawfully interrogated without counsel and illegally detained. He was eventually released from physical custody on December 3, 2021. Before Plaintiff was arraigned, PO O'Rourke caused a criminal complaint to be filed against Plaintiff, which falsely accused him of a number of crimes. The POs collectively fabricated evidence against Plaintiff, and Plaintiff was detained for three days.
