Plaintiff was in the living room for about 10 to 15 minutes when NYPD Officers raided the house. NYPD Officers raided the house without a warrant or probable cause justifying the unlawful entry, search, and seizure of the home and the people in it. NYPD Officers were actually entering the home to arrest Plaintiff and other attendees of the party as investigation for a shooting based on their discriminatory prejudices against African Americans. Defendant Detective Blake lied to the court saying that while outside he observed Plaintiff in the apartment throw a bag behind a couch which is insufficient to establish probable cause. Defendant Detective Blake and DeGaetano relied on this false observation when committing the false arrest of Plaintiff and later malicious prosecution of Plaintiff. Defendant NYPD Officers yelled at Plaintiff and assaulted and battered him through their unlawful seizure and arrest of him.  No officers intervened during this misconduct.
