Plaintiff was placed in excessively tight handcuffs, violently placed into a police transport vehicle, and transported to the 47th precinct. At no time did the officer-defendants read plaintiff his Miranda rights.\n\nNYPD Officers, including Vandyke, fabricated false charges of criminal possession of marijuana in the second fourth, and fifth degrees, as well as one count of unlawful possession of marijuana. Plaintiff repeatedly requested his handcuffs be loosened due to the substantial pain resulting from their excessive tightness.  While in custody, defendant-officers, including Vandyke, returned to plaintiff's home and removed trees from his backyard. Plaintiff was fingerprinted, photographed, search, confined to a cell, and ultimately transferred to central booking. While in custody, plaintiff sought medical treatment due to physical injuries arising from the search, seizure, detention, and transportation actions conducted by defendant-officers, including Vandyke.  Plaintiff alleges that defendants' actions arose in order to incur additional overtime compensation. benefits and career inflation, in conformity with NYPD practices.
