The defendants turned on their alarms, and jumped out of the truck. The defendants came towards the plaintiff with their guns drawn and ordered the plaintiff out of his vehicle. Defendant-DiMartino proceeded to slap and grab plaintiff on his head, threw plaintiff to the ground, and started slamming his knees into plaintiff's back. Defendant-DiMartino twisted plaintiff's wrists violently, handcuffed plaintiff and accused the plaintiff of \"running from\" the NYPD and being in possession of drugs. Defendant-Martino pushed plaintiff onto a tree, pulled plaintiff's pants down, and performed a search. Defendant-Martino proceeded to kick the plaintiff, laughed at plaintiff, and used derogatory comments to refer to persons of Puerto Rican heritage (plaintiff had an 'I Love Puerto Rico' keychain at the time). Plaintiff was assaulted for forty-five (45) minutes in the street as a crowd formed. Defendant Sylvester repeatedly told plaintiff to \"ask me for any favors\". Defendants Sylvester, Sherman, and another NYPD Officer were present and failed to intervene. While awaiting an NYPD-transport vehicle, Defendant-Martino took everything out of plaintiff's car.\n\nThe plaintiff was transported to the 72nd precinct. The plaintiff was told by the NYPD that he was being arrested for a warrant and a suspended license. These charges were substantiated through the defendant's bad faith filing of an accusatory instrument. The plaintiff was falsely imprisoned for one (1) day in the holding cell at the 72nd Precinct.
