Plaintiff was receiving a haircut at a nearby barbershop when Defendant officers Roberts and Moran approached his motorcycle. Plaintiff was informed by his barber that police officers had approached his motorcycle. Plaintiff left the barber shop to speak to the Defendants. Then, Plaintiff informed the Defendants that the registration sticker on his motorcycle had expired however he had temporary registration on his phone. Plaintiff was informed that he was going to have his motorcycle towed for having expired registration. Plaintiff was unlocking the bike so that it would be towed safely, when he was asked to move away from the vehicle by the defendants. Defendants asked for his identification and were told he would be arrested if he did not provide it. Plaintiff provided the Defendant Officer with his identification. Shortly thereafter, approximately six patrol cars approached the location and Defendants, including Defendant officer Titus, and John and Jane Doe 1-8 approached and arrested without probable cause and falsely charged with Obstruction of Governmental Administration. Defendants acting under color of state law, unlawfully arrested and detained Plaintiff and unlawfully searched him without consent. As a direct and proximate cause, Plaintiff was arrested and taken to the Precinct and was subjected to an intrusive search, his belongings were taken and vouchered and he was subjected to fingerprinting and photographing. Plaintiff was unlawfully detained at the Precinct for approximately fourteen (14) hours before being taken to central booking. Plaintiff was arraigned and offered an Adjournment in Contemplation of Dismissal and released.
