The Plaintiff attempted to break up the fight and was knocked unconscious. Upon regaining consciousness, the Plaintiff rose and began walking to his apartment. The Plaintiff was then grabbed by NYPD Defendant P.O. Siciliano, who demanded the Plaintiff accompany him to the local precinct. The Plaintiff complied. At the Precinct, the Plaintiff was questioned at length about a firearm, which at no point did he possess or have any knowledge regarding. The Plaintiff was subsequently arrested and charged with two criminal offences related to firearms, despite there being no evidence, physical, forensic or otherwise linking the Plaintiff to a firearm. Furthermore, the NYPD possessed exculpatory evidence which would have exonerated the Plaintiff of the charges. The NYPD provided false/misleading information to the DA's office regarding facts and circumstances supporting the Plaintiff's arrest. Plaintiff's six children were also sleeping in the apartment. At 2 am, Plaintiff heard loud banging at the door and multiple voices repeatedly screaming \"Warrant!\" Plaintiff opened the door and four to six plain clothes officers, including Daniel Sweeney, rushed into the apartment without Plaintiff's permission. When an officer asked who lives in the apartment and the Plaintiff responded herself and her six children, the officer looked surprised but proceeded to assert that there were guns in the house, which the Plaintiff denied. When Plaintiff's daughter tried to call the police, an officer snatched her phone and removed the battery. Another officer then found a gun which Plaintiff asserted she was unaware about and Plaintiff is arrested. When Plaintiff arrives at the precinct, she is instructed to sign a document setting forth who the gun belongs to, which she signs saying it belonged to her mother as officers promised she would not get a felony and lose her job if she signs. Plaintiff was processed 2 hours later and released at 11 am the following morning. Plaintiff later discovered that the police did not have a warrant for her arrest or to search the apartment. Once a trial was set, the A.D.A. adjourned the case multiple times and continued the prosecution for almost three years. On the last court date on August 18, 2015, the case was dismissed. The state did not produce any witnesses during the three years of prosecution.
