Plaintiff had been sitting in his parked car awaiting AAA assistance for a dead battery. Officers approached his car and Ofc. Perezromero ordered plaintiff to exit his vehicle. Plaintiff complied. Ofc. Perezromero proceeded to falsely accuse plaintiff of hitting a fire hydrant. Plaintiff denied. Ofc. Perezromero asked if plaintiff had been drinking, and plaintiff said no. Ofc. Darrion Grant then asked plaintiff to take a breathalyzer test and plaintiff declined. Ofc. Grant then placed plaintiff under arrest and handcuffed him. Ofc. Perezromero questioned plaintiff about his hood being slightly open and plaintiff explained the situation, offering to show them his phone to substantiate his claim that he was awaiting AAA assistance. Officers looked at his phone and confirmed that plaintiff was being truthful. Sgt. Czplinksi and Ofc. Lawrence Lechmanski arrived on scene and plaintiff again explained the situation. Still, the officers proceeded with the arrest and took him to a precinct. Plaintiff was imprisoned for four hours and then taken to booking. He was informed that the charges were dismissed insofar as the DA declined to prosecute.
