When she woke up, the driver was on top of her in the rear seat of the taxi.  That in an ensuing effort to escape what was a physical and attempted sexual assault on her by the taxi driver, she up falling or being ejected from the taxi cab and striking the adjacent pavement, losing consciousness and sustaining physical injuries. A witness tried to confront the driver but he escaped on foot.\nDefendants NYPD Officer Md Islam, together with other NYPD officers, arrived at the scene and observed an obviously injured Plaintiff who told them what just happened, and showed a video camera that would corroborate plaintiffs’ version of events.\nWhereas all evidence showed that she was the victim, Defendants placed in \nhandcuffs and under arrest the victim and the witness without probable cause. They transported them to the Precinct and charged her for a crime she did not commit, Theft of Services.
