Approximately 6 police officers, including Defendant Austin and Doe defendants, came to residence after responding to a call involving an incident that occurred approximately four (4) days prior to this incident. Plaintiff asked Defendants what was going on. Defendant Austin told Plaintiff he was going to shock him with a taser despite the fact that he lacked any justification to do so. Defendant Austin then tased Plaintiff as he was getting off his bed in compliance with Defendant Austin's orders and handcuffed him. The NYPD officers who were in the room and in the doorway who had the opportunity to intervene to prevent this unlawful use of force but failed to do so. After being handcuffed, Plaintiff was tased again. Plaintiff temporarily lost consciousness and suffered a great deal of pain, and required medical care for his injuries.
