Mr. Callahan went to the store, and felt secure leaving his children at home with the door locked, because the building was manned 24 hours a day. He returned to find that the children had been removed by Child Services. Upon reporting to the 79th precinct, he was arrested on arrival and held for several days. On August 16th, an Article 10 petition was filed against Plaintiff and his wife. After 19 months, the petition and all criminal charges were dismissed for failure to establish impairment or imminent risk. For those 19 months his children were removed from his care and put back in their biological mother's custody (who had lost custody in prior family court hearings). Mr. Callahan brought this action against Patricia Smith (Child Services Case Worker), Sgt. Robert Holt (NYPD), Ofc. Robert Holt (NYPD), and Ofc. Jimmy Ponce (NYPD). Claims include a Due Process violation because was not offered a pre-depravation hearing, initial counsel for the hearing, proper notice of a hearing, or a post-depravation hearing. Additionally, False Arrest, Malicious Prosecution, and that a lack of training led to these events. Mr. Callahan attempted suicide two times as a result of the emotional distress inflicted on him by the depravation of his children and the burdensome process he and his family endured.
