Defendants, including Robert Weinberg, Sergio De La Mota and John or Jane Doe 1-10 illegally searched the Plaintiff and falsely arrested the Plaintiff for possession of marijuana. Plaintiff had not committed any crime or violation of law. Defendants used excessive force while arresting the plaintiff and battered the plaintiff including placing him under tight handcuffs. Plaintiff was transported to the 44th precinct where he was illegally searched, including a strip-search with cavity inspection, questioned, photographed and fingerprinted by the Defendants. Defendants Weinberg and De La Mota were involved in initiating an unjust criminal investigation against the Plaintiff. This action was taken as revenge for the Plaintiff's successful civil lawsuit against Weinberg, which had led to disciplinary measures against Weinberg and other consequences. Plaintiff was unlawfully detained until he was released on March 12, 2019. Plaintiff had to go to court multiple times to fight false charges, including Criminal Possession of Marijuana. On April 2, 2019, the Bronx Criminal Court dismissed the charges in the Plaintiff's favor. Defendants lacked a valid arrest warrant, had no probable cause for the arrest or seizure of the Plaintiff, and did not have grounds to believe that the prosecution would succeed or that the Plaintiff was guilty of any crime.
