The warrant was based on knowingly falsified information and obtained from coercion of an informant. While executing the search Lopez and Vasilopoulos planted and moved weapons and staged photographs to support their false information. Lopez and Vasilopoulos recovered an envelope with Plaintiff’s name on it from the premises that purports to link him to the possession of weapons. On March 8, 2021, Plaintiff was falsely arrested, detained, and taken to Kings County Central Booking by Detective Raymond Higgins where he was charged with numerous weapons possession charges. Due to these false charges, Plaintiff could not post bail and spent 6 weeks in Rikers Island for at least 6 weeks and incurred legal fees in excess of $15,000. After a suppression hearing on March 3, 2023, prosecution moved to dismiss Plaintiff’s indictment and the motion was granted. On March 4, 2021, Plaintiff was brutally assaulted by a person out on bail for second degree murder charges and lawfully defended himself. Detective Higgins coerced the assailant to press charges through threats regarding his pending charges, despite the fact that the assailant was an unreliable witness. On January 13, 2021, Plaintiff was falsely accused of burglarizing his own apartment that he was residing in as a lawful tenant. Plaintiff was falsely arrested by PO Alexander Caballery and taken to Kings County Central Booking where he was arraigned on a felony criminal complaint, despite a complete lack of evidence to substantiate the claims. On May 2022, Plaintiff was unlawfully arrested outside of his lawful residence after calling 911 when he was being attacked by a person for whom he had an order of protection. Despite the fact that Plaintiff did not resist arrest, POs Andrew Demichael, Michael Nuccio, and Amado Lipana struck plaintiff with their boots and closed fists and body slammed him onto the ground face first, where Plaintiff was ultimately rendered unconscious. At Kings County Central Booking the officers falsely claimed that Plaintiff had assaulted them during the arrest, and Plaintiff was charged with numerous assult charges and sent to Rikers Island. The defendants demanded Mr. Pasquale open his door, and when he refused and directed them to the upstairs apartment, they broke down his door. Despite not having any warrant, consent, or cause to enter Mr. Pasquale's apartment, the defendants entered and assaulted Mr. Pasquale, causing serious injuries that required his later being brought to the hospital. Defendant Officers Nelson and Cilento then placed him under arrest.
