Plaintiff and her mother lived in the same apartment building, but on different floors. Defendant Detective Felix Garcia unlawfully entered and searched for Plaintiff’s stepbrother in Plaintiff’s apartment, without a warrant. Defendant Detective Garcia knew that Plaintiff lived in the apartment he entered unlawfully. On May 25, 2021 at 7:45AM, defendants searched for Plaintiff’s stepbrother at his mother’s apartment and then they went to plaintiffs apartment. They began kicking the front door of Plaintiff’s apartment. Plaintiff spoke with defendants through the front door of her apartment and let them know she was not going to open her door because the person they were looking for was not in the apartment. Plaintiff opened the door to see the alleged search warrant they had, and when the door was open, they stuck their leg in the opening of the door to prevent her from closing the door. Defendants showed her a warrant from Utah that was for her mother’s apartment and not her apartment. Defendants would not allow her to close the front door of her apartment and eventually Plaintiff let them in because they would not allow her to close the door and informed her that they would enter anyways. Defendants searched areas of the apartment where Plaintiff’s step brother could not be located, such as inside of drawers and in the microwave. Defendants did not find Plaintiff’s stepbrother and concluded their search. \n\nOn June 23, 2021, Defendants knocked on Plaintiff’s door at 7AM and Defendants asked Plaintiff what she was trying to hide and they informed her she would be criminally prosecuted if she did not open the front door. They also informed her that they would break down the front door and Plaintiff let them in following the threats. They once again performed a search and concluded it once they did not find Plaintiff’s stepbrother.\n\nOn August 19, 2021 at 8AM, Defendants began knocking again and informed them they would use a battering ram to break down the front door of the apartment. Plaintiffs asked for a minute to get dressed and when they opened the door, the Defendants prevented them from closing it once again. This time, they were not given permission to enter the apartment. Defendant Detective Garcia pushed one of the Plaintiff’s out of the way, causing her to fall to the ground in order for him to gain entry into the apartment.
