Cruz began to drive and a short time later POs John Sullivan and John Does stopped the car, removed all three individuals, handcuffed them, and placed them under arrest despite the fact that at no time had Plaintiff committed a crime or violation. The three individuals were placed on the sidewalk and two witnesses to a burglary approached. The witnesses identified Cruz and Kenny Urena as involved but did not identify Plaintiff as having been involved. Despite this Plaintiff was taken to the Housing PSA 9 Precinct where he was strip searched--without result--then taken to Central Booking. Plaintiff remained in custody until August 29, 2015. Plaintiff was charged with Burglary and related offenses.
