Prior to the arrest, plaintiffs were passengers in a vehicle driven by a friend. On their way home, they were pulled over by defendants. One of the plaintiffs, Ms. Tolbert was engaged in a telephone conversation at this time, and one of the defendant officers rushed over to her and forcibly pulled her out of the vehicle while yelling at her for engaging in a telephone conversation. Defendants then slammed her down on top of the hood of the vehicle. Defendants tightly handcuffed Ms. Tolbert, forcibly grabbing and twisting her arms in the process. Defendants slammed her on the ground and were pushing, kicking, hitting, beating and punching her all over her body. As the other plaintiff and witnesses pleaded with defendants to leave Ms. Tolbert alone, defendants seem to intensify the assault. Defendants also forcibly grabbed the second plaintiff, Ms. McCrea, and tightly handcuffed her. Defendants ignored plaintiffs' requests to loosen the handcuffs. While being questioned Ms. McCrea informed the defendants that she was engaged to Ms. Tolbert and they were returning from CT with their marriage license. The defendants falsely accused her of lying and indicated she was a prostitute. Defendants also falsely alleged that Ms. Tolbert told them she picked up Ms. McCrea from the street and attempted to pressure Ms. McCrea to turn against Ms. Tolbert. Ultimately, defendant officers advised Ms. McCrea to break up with Ms. Tolbert and find “a good looking man who cares about [her] to marry.” Defendants requested plaintiffs request for medical treatment and denied the plaintiffs access to medication, food and drink, as well as contact and visitation by friends and family. Defendants later falsely stated to the prosecutors, among other things, that the plaintiffs stole certain properties. The prosecutors subsequently conducted an independent investigation and concluded that there was no evidence of any crime committed by either plaintiff. As a result, the prosecutors declined to prosecute the plaintiffs.
