As he walked by, Plaintiff asked the officers what was going on. In response, PO John Doe 1 told Plaintiff to get off the sidewalk, prompting Plaintiff to suggest that it was, in fact, a public sidewalk. Plaintiff then turned to leave. As he walked away from the park, Plaintiff was struck from behind by PO Doe 1, resulting in his falling facedown in the street and losing consciousness, while PO Does 2–6 stood by and watched. \n\nPlaintiff woke to PO Doe 1 handcuffing him, knee in his back. From these uses of force, Plaintiff suffered bruising to his chest as well as bruising and nerve damage due to the tightness of the handcuffs. Plaintiff was arrested and taken to the precinct, where PO Middleton issued him a summons falsely charging him with disorderly conduct.
