Many of these POs had a known history of violent misconduct. Plaintiff called 911 for an ambulance outside the precinct and EMTs shortly responded. While Plaintiff was talking with the EMTs POs again assaulted Plaintiff, pushing and striking him, pointing tasers at him, grabbing and twisting his arms, pressing knees against his back, and affixing excessively-tight handcuffs to him. The assaults caused Plaintiff physical injury to the neck, lower back, right ankle, shoulders, right hip, and both wrists as well as head swelling and compressions in the back. POs intentionally falsified information to initiate a malicious prosecution against Plaintiff. On said date and said time, Plaintiffs were lawfully present in a vehicle, that did not belong to either of them, as passengers with another non-party individual driving in the vicinity of this complained-of-incident. No contraband was recovered from Plaintiffs’ person or belongs to indicate that they committed any crime. The defendants then grabbed Plaintiffs about their body and extremities before violently contorting their arms and wrists behind their back and applying excessively tightened metal handcuffs, causing plaintiffs to experience significant pain and discomfort. Plaintiffs complained to Defendants and requested that the handcuffs be loosened, but said defendants ignored plaintiffs’ pleas. The defendants then placed Plaintiffs in a police vehicle and transported them against their will to the 47th NYPD Precinct where Plaintiffs were fingerprinted, photographed, searched or strip-searched, questioned as to their pedigree, illegally interrogated without presence of counsel and being Mirandized, and illegally detained in a dank and dirty cell for a length of time before being transported to Central Booking, where Plaintiffs were again processed pursuant to criminal incarceration and illegally detained throughout various dank and dirty cells over the course of a length of time until Plaintiffs were released from physical custody on or about July 17, 2020 after their arraignment. As a result, Plaintiffs were deprived of their liberty over the course of approximately three (3) days.
