Plaintiff swiped his metro card and lawfully got on the 4 train headed downtown to start his shift working for PostMates and DoorDash. The subway train traveled one stop, to Franklin Avenue, when there were about 10 NYPD John Doe Defendants standing on the platform. The Defendant Police officers entered the subway train, with guns drawn. The Defendant Officers, by pointing their guns aggressively, scared and\nterrified an entire subway car of rush hour commuters, including the Plaintiff. Defendant Officers screamed at Plaintiff, \"get on the ground\" to which Plaintiff complied. Defendant Officers immediately grabbed Plaintiff, threw him on the ground, and handcuffed him. The Defendant Officers then jammed their knees into his back, and punched him in the head, causing serious physical injury. Plaintiff was unlawfully arrested and handcuffed by defendant officers without legal justification or probable cause. \n\nDefendants then transported Plaintiff to the 77th Precinct police station against his will, where Plaintiff was unlawfully photographed, fingerprinted and detained in a holding cell. Plaintiff repeatedly asked for medical attention, but the Defendants refused to take him to a hospital. Plaintiff was then transported to Kings County Central Bookings. The defendant police officers provided the District Attorney's Office with the false information that Plaintiff committed the crime of fare evasion. On October 26, 2020, after approximately 24 hours unlawfully in police custody, Plaintiff was arraigned in Kings County Criminal Court and charged with crimes that the defendant officers had no basis to allege that he committed.
