Among those individuals was Mr. Adil Khan. Attempting to comply with Covid-19 restrictions, Plaintiff and other volunteers requested that only Officer Taylor and two of the civilians enter, and that the rest use the second-floor prayer room. Officer Moseley-Jones called Plaintiff after the prayer service and asked to meet with him outside, where she questioned why he did not permit the full group to enter the first floor. Plaintiff reiterated the social distancing requirements. Later that day, Officer Moseley-Jones went back to the 70th precinct and completed a report alleging Plaintiff had assaulted Mr. Adil Khan during the interaction in the prayer room. Officers Anthony Nevandro and Yevgeniy Belov approved the report. This interaction had been recorded by CCTV, and showed that Plaintiff had not touched any member of the group. The report initially charge non-criminal harassment, later changed to third-degree assault. On June 25, 2021 Officer Brathwaite arrived at the mosque with NYPD officers John/Jane Does 1-15, and arrested Plaintiff. They handcuffed him tightly, such that his wrists bled. Plaintiff stepped aside to get out of PO Santiago's way, thinking that he was in the process of chasing someone else. When PO Santiago reached Plaintiff, he jumped on him, pushed him hard against a wall, face first, and handcuffed him behind his back. PO Santiago and PO Viodelys Brathwaite took Plaintiff to the precinct, and Sergeant Brian Barra approved the arrest. Plaintiff kept asking why he had been arrested, but it took a couple of hours before an officer, Captain Komar, told Plaintiff that he had been arrested because he had allegedly urinated in public. That accusation was false. Plaintiff said that he wanted to call his lawyer, but was told by Captain Komar that he could not let Plaintiff make a phone call until they had taken his fingerprints. In the early morning of September 11, 2012, about five officers, including, upon information and belief, Sergeant Terence O'Donohoe, came into Plaintiff's cell, woke him up, and told him to stand up. Four of the officers held Plaintiff and Sergeant O'Donohoe stood in front of him and pointed a taser gun first at his heart and then between his eyes. Sergeant O'Donohoe threatened that if Plaintiff did not give him his information, he was going to taser Plaintiff. Sergeant O'Donohoe did not end up tasering Plaintiff but punched him in the face several times, while Plaintiff was being held by the other officers. Plaintiff fell down to the floor and began bleeding from his nose. While Plaintiff was down on the floor, some or all of the officers kicked Plaintiff several times and then left the cell. \n\nLater, around the evening of September 11, 2012, when Plaintiff had been brought back to the precinct from the hospital, Sergeant Therese Garafalo approached Plaintiff very abrasively and told him that if he did not give them his information, they were going to make sure that he was carried out in a black body bag. He was then transported back and forth between Central Booking, the hospital, and the precinct several times. At one time, while at the precinct again, he was punched and kicked by officers, in front of Captain Komar who did not intervene. Plaintiff was falsely arrested and imprisoned, without probable cause, for almost four days. On September 14, 2012, when he finally got to see a judge, the judge and Plaintiff’s legal aid attorney both said that the case was dismissed and that Plaintiff was free to go.
