Unbeknownst to Plaintiff, P.O.s Garcia and Ramos arrived at the building in response to a report of stolen packages. Plaintiff spoke to Officers Garcia and Ramos about his girlfriend’s stolen package. Officer Garcia became hostile when Plaintiff asked questions about how to fill out a report, telling him to call 911 or 311. Officer Ramos attempted to provide Plaintiff with a form, but Officer Garcia intervened and told Plaintiff that his girlfriend should call the police. Plaintiff was frustrated and started to take down Officer Garcia’s shield number, which caused Officer Garcia to threaten arresting Plaintiff. Plaintiff held out his arms and sarcastically told her to do so, and Officer Garcia placed his hands behind his back and arrested him. Plaintiff was taken to the precinct and released three hours later. On October 29, 2019, Plaintiff appeared in court and was charged with Menacing in the Third Degree. Officer Garcia related false allegations to the D.A.’s Office concerning the incident, as the video of the arrest makes clear. After Plaintiff's son told several NYPD Officers who were present in the area that he wanted to gain access to Plaintiff's home, Plaintiff explained to the officers that her son did not reside with her and that he needed to be taken to a hospital for medical assistance due to his mental illness. After several other NYPD officers, including Defendants GARCIA and GAMWELSH arrived at the scene, Plaintiff was told that she would be arrested if she did not allow her son into her apartment. After Plaintiff refused, she was arrested, verbally abused by the Defendant officers, and suffered injury to her arm and back as a result of their use of excessive force. Plaintiff was taken to the 28th Precinct and then Central Booking where the Assistant DA told the officers to remove the handcuffs and the DA subsequently refused to prosecute.
