Officer Fadugba called Officer Kenny Tucker to come to the scene to arrest Plaintiff for driving while intoxicated. Plaintiff maintained he did not consume any alcoholic beverages. Plaintiff was arrested and taken to the Intoxicated Driver Testing Unit and took a breathalyzer exam, without receiving proper refusal warnings. However, the officers later alleged Plaintiff refused to take the test. Plaintiff was held in custody for approximately 24 hours.  Officers Fadugba and Tucker manufactured false, unreliable and/or misleading evidence for prosecution, and the DA's office withheld exculpatory evidence and failed to call a witness.  \n\nWhile the criminal matter was pending, Officer Fadugba, the only officer who supposedly observed Plaintiff operating a vehicle while intoxicated, had been deployed overseas. The DA refused to dismiss the case. Plaintiff's case went on for more than 3.5 years, requiring approximately 25 court dates. On each court date, Plaintiff had to take a day off from work, resulting in over $17,000 in lost wages.
