The door was broken down by Rafael and the officers entered the apartment. They failed to prevent Rafael to enter the apartment. The officers discharged their firearms at Rafael. Decedent was outside of his friend's apartment when POs John and Jane Does arrived and asked Decedent, a former body builder, to break down the door to his friend's apartment. Decedent did so and entered the apartment, an active crime scene, along with POs. POs then fired dozens of shots inside Decedent's friend's apartment, killing her ex-boyfriend and killing Decedent with a gun shot wound to his back. POs failed to administer adequate medical aid to Decedent. Sgt. Golden was one of the supervisors on scene to respond to the shooting. After the shooting PO Erin Frawley, Sgt. John Henderson, Sgt. Tsang, Sgt. Golden, Sgt. Chisholm, Det. Louis Yero, and other POs conspired to lie to Decedent's family about the nature of his death. Specifically, they fabricated an official complaint report which stated Decedent was stabbed by the ex-boyfriend and succumbed to this injury. However, on October 1, 2014 the medical examiner concluded Decedent had not sustained any stab wounds and instead died of one gunshot wound to the back. Decedent suffered severe physical injuries resulting in death, pre-death pain, and emotional and psychological distress and horror as a result of this incident.
