Plaintiff, who maintains that he did not assault anyone, was incarcerated for approximately seven days and had to attend three court appearances. On September 26, 2014, the criminal charges were dismissed at the prosecutor's motion.\n\nOfficers violated Mr. Torchon’s Fourth and Fourteenth Amendment rights by arresting and detaining him without probable cause. In addition, officers falsely arrested the Plaintiff, falsely imprisoned, maliciously prosecuted, assaulted, battered, and were negligent. There was also negligent hiring and supervision of the officers involved. The City of New York and the NYPD maintained policies and practices enabling such misconduct.
