Plaintiff's job involved managing ticket-selling agents and selling tickets for boat tours leaving Battery Park. Plaintiff held a valid ticket-selling license issued by the New York City Consumer Affairs Department. Plaintiff was at the intersection of Battery Place and West Street, on the public sidewalk abutting Battery Park. around noon Plaintiff was approached by Defendant Officers, SAAD, EGILMEZ, TIETJEN, and ARNOLD. Defendant officers approached Plaintiff from behind and demanded to search Plaintiff. Plaintiff objected as he had not committed a crime and the Defendants had no probable cause or reasonable suspicion. Plaintiff requested that they let him walk away. Instead, when Plaintiff walked away from Defendants in concert assaulted, battered, and used excessive force against Plaintiff by striking him forcing him from his feet to the ground, and striking him on the head with objects believed to be Defendants' police batons. After Plaintiff fell to the ground, Defendants continued to restrain and strike him while he was in the prone position,  After he was restrained defendant SAAD repeatedly punched Plaintiff in the head. Plaintiff did not attempt to resist . Defendants refused to provide any medical treatment to Plaintiff and refused to ensure Plaintiff went to the hospital until bystanders called an ambulance. Defendant ARNOLD was directly questioned at the scene by bystanders who accused him of striking Plaintiff excessively with his weapon. He remained silent in the face of accusations. \n\nAt the hospital, Plaintiff was displaying clear signs of a traumatic brain injury. Defendants TIETJEN and ARNOLD were not honest with the medical staff about the extent of the force used. They also did not tell hospital staff Plaintiff had taken repeated strikes to the head from police batons and instead only claimed Plaintiff had been punched in the face 3 times. Furthermore, they did not tell hospital staff plaintiff became mute and unresponsive at the scene. Defendants TIETJEN and ARNOLD prevented Plaintiff from receiving a complete medical evaluation to prevent medical staff from understanding the extent of the injuries. instead they claimed Plaintiff was suffering a psychiatric episode and he needed to be sedated before they would remove the handcuffs and allow staff to treat him. The plaintiff feared for his safety as he is allergic to Haldol. Plaintiff vehemently refused to be injected with a medication that he knew could seriously harm or kill him. Medical staff agreed not to sedate him. However, this meant that Defendants would not allow him to get treatment. Defendants TIETJEN and ARNOLD prevented Plaintiff from receiving a necessary and complete medical evaluation and removed him from the hospital within just over one hour after his arrival.\n\nPlaintiff was then taken to the 1st precinct. he continued to show signs a brain injury. Defendant ARNOLD threw Plaintiff to the ground in front of the desk. Plaintiff was left there for several minutes before being brought into a holding cell. there Defendants LOPEZ, TIETJEN, and ARNOLD assaulted, battered, and used excessive force against Plaintiff. Defendant LOPEZ punched Plaintiff in the face while he was rear-handcuffed and held by multiple officers and in front of TIETJEN and ARNOLD who failed to intervene. Before striking Plaintiff, LOPEZ intentionally obscured his Body Worn Camera. Defendant LOPEZ admitted on the recording to both punching Plaintiff and that he intended to make false statements in NYPD paperwork. Defendants processed Plaintiff’s arrest, prepared paperwork related to his arrest, and conferred with the District Attorney’s office to bring criminal charges against Plaintiff. Defendants communicated with a representative DA  and presented false evidence to the prosecutor. The plaintiff was arraigned on January 8, 2020, and released on his own recognizance. Plaintiff was licensed and authorized to be in the park selling tickets. Defendant NYPD Officer Saad approached plaintiff with defendant U.S. Park Police officers. They asked to search plaintiff, which he declined. When he attempted to leave, the defendants struck him with their batons, forced him to the ground, and repeatedly struck his head with their fists. A bystander called an ambulance, but defendants gave false information to hospital staff, refused to allow medical treatment of plaintiff, and removed him from the hospital into police custody.\n\nAt the NYPD precinct, plaintiff was handcuffed and placed in a holding cell, where defendant NYPD Officer Lopez and the Park Police continued to strike him. Lopez then drafted a false criminal complaint to justify the excessive force, resulting in plaintiff's arraignment on criminal charges.
