Plaintiff was searched but no contraband was found. Pena falsely informed the Brooklyn DA they found marijuana on Plaintiff’s person, and signed a Criminal Complaint which commenced a criminal proceeding against Plaintiff. After six hours at the Precinct, plaintiff was transported to Brooklyn Central Booking. Plaintiff spent twenty hours at Central Booking before appearing for arraignment.
