The arrest and imprisonment followed after Plaintiff had been the victim of a violent encounter with her toddler son’s father on October 29, 2021; the man had, inter alia, struck Plaintiff’s car windows and caused glass to shatter over the face of a passenger in Plaintiff’s car. Fearing for her safety, Plaintiff had driven down the street until she had found police officers to whom she had explained the situation, after which Plaintiff had been informed that the officers were going to look for the man and that Plaintiff was allowed to leave. On November 1, 2021, Plaintiff received a call from PO Crystal Jackson, who had not been present at the scene a few days prior. PO Jackson informed Plaintiff that she had to turn herself in or a warrant would be issued. At PO Jackson’s direction, Plaintiff turned herself in on November 3, 2021. At the precinct, PO Jackson confiscated Plaintiff’s phone and keys, placed Plaintiff under an unlawful arrest, and caused Plaintiff to be transported to court to await arraignment. Rats ran around in the cell Plaintiff was in, causing Plaintiff to begin suffering a panic attack. When asking to be brought to the hospital, Plaintiff was informed that her case had been dropped by the DA’s office. Plaintiff was released without any charges being filed against her, after being deprived of her liberty for approximately ten hours.
