Plaintiff Garcia was brought into an interrogation room by Detective Armel Moore, who indicated that Plaintiff Garcia was a suspect and asked if he would give a statement. After his stepfather questioned what the investigation was about, Detective Moore told Plaintiff Garcia that he would be taken to Rikers Island and charged as an adult if he did not give a statement. After his stepfather hired an attorney, Detective Moore allegedly said that Garcia would still get arrested. Plaintiff Garcia was taken to a lineup room and held for two hours; he was then photographed and fingerprinted and kept in the lineup room for six more hours.\n\nPlaintiff Garcia and another youth in the lineup room were then taken to seats next to the holding cell and cuffed uncomfortably to chairs. Plaintiff Garcia asked if the cuffs could be loosened and Detective Moore and another unnamed officer refused. Another officer replaced the unnamed officer, but still refused to loosen the handcuffs. His hand started swelling and feeling painful; due to this, Plaintiff Garcia was unable to sleep as he was held in such a handcuffed position for twelve hours. He was taken to juvenile court with the other youth the next morning. Detective Moore was told that he should have brought the two youths the day before and was given an appearance ticket and released. Plaintiff Garcia’s parents noticed the injury to his hand and got him medical attention.
