Bowens, who threw Plaintiff Barnes against a wall. Defendant P.O. Bowens had no articulable suspicion that a crime had been committed by Plaintiff Barnes. Defendant P.O. Bowens claimed Plaintiff Barnes was in possession of a quantity of crack cocaine weighting in excess of 500 milligrams in that Defendant P.O. Bowens claimed he observed Plaintiff Barnes throw the drugs to the ground. Plaintiff Barnes had a prior felony at this time and in order to avoid a greater sentence pled guilty.  On February 16, 2005 Plaintiff Barnes was sentenced to an indeterminate term of imprisonment of 1.5 to 3 years.\n\nOn January 18, 2008, Defendant P.O. Bowens was arrested on charges of corruption, falsifying business records and other police misconduct related cases. In 2009, while Defendant P.O. Bowens' criminal case was pending, he shot and\nkilled his ex-girlfriend, and was sentenced to 40 years to life. \n\nOn or about November 4, 2022,  Plaintiff Barnes' criminal Court Counsel\nmoved to vacate his conviction pursuant to a writ of error coram\nnobis.  Plaintiffs conviction was vacated and the indictment dismissed with prejudice pursuant to an order of the Supreme Court, of the State of New York.\n\nIn commencing and continuing the prosecution of plaintiff, defendants\ncaused plaintiff to be falsely charged with acts in violation of the Penal\nlaw of the State of New York. In the summer of 2022, the Kings County District Attorney’s Office’s Conviction Review Unit re-investigated several convictions involving officers later convicted of crimes or known to have committed misconduct and falsified criminal charges against innocent people. Defendant Officer Jerry Bowens was one of these officers.
