At this point, Mr. Marcellin called out for assistance from Defendant Officers Persad and Corbin (who he knew from the neighborhood), but these officers failed to intervene.\n\nAfter a series of escalations, Mr. Marcellin yelled that he would find out where the officers lived and assault their children. In response, Defendant Officer Devane yanked Mr. Marcellin out of the car, and Defendant Officer Berkowitz tased him in the chest multiple times. Defendant Officers Devane, Mercurio, Foss, Marcus, Dempsey, Farese, and Camerada kicked Mr. Marcellin as he lay on the ground. Mr. Marcellin was then placed in the police vehicle, and the defendant officers refused to provide him with his asthma inhaler.\n\nAt the precinct, Defendant Officer Devane then searched Mr. Marcellin's genital area and left him in a cell in his underwear.
