Plaintiff was take to the precinct and remained there for approximately twelve hours before being transported to Bookings, where he remained for approximately another twelve hours before arraignment. P.O.s gave false information to the D.A.’s office, alleging that Plaintiff was engaged in criminal sale of a controlled substance. As a result, the Judge set bail to an amount the Plaintiff could not make and Plaintiff was held until August 18 before being released. Plaintiff spent $10,000 on a private defense attorney to fight the false allegations. P.O.s continued to repeatedly raid Plaintiff’s cellphone store, raiding it two times in the ensuing six months after his false arrest. Defendant Porter was the deponent of the Criminal Court Complaint lodged against the plaintiff, and states that he was informed by John Doe Undercover that he observed the plaintiff having a conversation with a separately apprehended individual, and handed a small object to the separately apprehended individual in exchange for U.S currency, This separately apprehended individual was found by Porter to have one zip lock bag of alleged crack cocaine in his pocket. It is believed that John Doe Undercover falsely identified the Plaintiff in a show up as having him allegedly engage in this transaction described earlier.
