Two witnesses called about the shooting, only one of whom is relevant here, D.T.. D.T. was under the influence of heroin, cocaine, and alcohol at the time of the shooting, and suffers from auditory and visual hallucinations. D.T. initially stated she saw nothing that would help identify the assailant, and security camera footage was only sufficient to prove the assailant was a 6'2\" black man. Despite this, defendant officers Wilfredo Acevedo and Kenneth Faulkner, and defendant ADA Rebecca Dunnan used the insufficient security footage and faulty testimony of D.T. to charge the 5'4\" plaintiff for attempted murder.    \n\nOn August 11, 2016 Acevedo offered to get money to D.T. in exchange for her meeting him, she declined. Ten days later he threatened her with arrest despite there being no basis for arrest. On September 10, 2016, Acevedo issued an I-Card on Norales, and departed from accepted police procedures by not memoralizing how Norales entered the investigation in a follow-up report. On October 4, 2016 D.T. sold cocaine to an undercover cop. She was brought in on October 27, and was arrested and interrogated for 2hrs and 45mins, indicating the police were pressing her to cooperate with their investigation. Defendant Faulkner on duty conferred with Acevedo about his theory that Norales was the shooter. Faulkner than prepared a photo array that included Norales as the presumptive shooter (on Acevedo's instruction). After 30 more mins, D.T. was showing signs of withdrawal and she allegedly identified Norales as the shooter. There were no immediate attempts to arrest Norales. After detoxing at Riker's, A.D.A. Dunnan, recognizing that D.T.'s identification at the precinct is insufficient for probable cause, conducted two interviews with her on November 21 and December 21 of 2016. A.D.A. Dunnan, during this time, became aware of D.T.'s mental health history, and that she was intoxicated with alcohol and heroin during the shooting and was high on heroin and crack cocaine when she identified Norales. Prosecutors offered D.T. a deal which lessened her sentence, and offered other perks, in exchange for her testifying that she saw Norales shoot M.G. (which she never did). On March 8, 2017, Norales was arrested by Acevedo. Dunnan and Acevedo, to supplment D.T.'s claims, decided that Acevedo should say he recognized Norales in the video. Acevedo did just that. Dunnan tailored her questions to Acevedo and D.T. to cover holes in their claims. Plaintiff was forced to return to court twice to defend against the false charges and on March 23, 2017 the charges were dismissed.
