The Defendants, \nfabricated a false narrative, in which they claimed that the Plaintiff, Mr. Surgeon committed one (1) count of Resisting Arrest, one (1) count of Criminal Mischief in the fourth degree, one (1) count of Unlawful Possession of Marijuana and one (1) count of Disorderly Conduct to place him under arrest, when they knew such claims to be untrue and complete fabrications. The Defendants also fabricated a false narrative, in which they claimed that the Plaintiff, Mr. Fenner committed one (1) count of Resisting Arrest, one (1) count of Obstructing Governmental Administration in the second degree and one (1) count of Harassment in the second degree to place him under arrest, when they knew such claims to be untrue and complete fabrications. The Plaintiffs were transported by Defendants to the NYPD 44th Precinct, where they were illegally searched, photographed and fingerprinted. Plaintiffs were wrongfully incarcerated over the course of eighteen (18) hours.
