Shortly after, Officers Bistany and Minutolo pulled up behind Mr. Singh's car. The officers told Mr. Singh to get off his phone and asked him how much he had been drinking. Mr. Singh repeated denied having anything to drink Officer Bistany asked Mr. Singh to take a breathalyzer. Mr. Singh complied and the test gave no evidence of any alcohol consumption. Officer Bistany contacted Officers Mantas and Petrucci, who both arrived on the scene. Once on the scene, Officer Mantas aggressively questioned Mr. Singh then handcuffed him and transported him to the 112th precinct. There was no dashboard camera activated at any point. \n\nAt the precinct, Mr. Singh refused to take a second breathalyzer. He was then questioned by Officer Mantas, asked to endure a 'Gaze Nystagmus' test, and a series of physical tests. This was videotaped by Officer Petrucci. Ms. Singh passed all tests, yet was processed through Central Booking and charged with VTL 1192-1 and VTL 1192-3. The officers hit Plaintiff Acevedo, breaking his glasses. One of the Defendants pepper-sprayed Plaintiff Santiago and threw him against a parked car. Both Plaintiffs were placed in handcuffs, and Defendants continued to strike Plaintiff Acevedo, who sustained injuries to his chest and face. Plaintiff Acevedo's requests for medical treatment were denied. After being transported to the precinct, the officers informed the District Attorney's office that they observed the Plaintiffs commit Obstruction of Governmental Administration, Resisting Arrest and Disorderly Conduct.
