Plaintiff, who had limited command of the English language, explained to the officers that she had an argument with her boyfriend and had called the police to help resolve their dispute. As Plaintiff was explaining, Officer Brown became more and more impatient. He told Plaintiff that she had no right to exclude her boyfriend from the apartment and ordered her to let him back in. Plaintiff, who was having difficulty understanding, asked the two officers for an explanation. Officer Brown suddenly grabbed Plaintiff's arm, threw her to the ground, and punched her in the face. He then grabbed her by the throat and pushed her up against the wall - choking and restricting her breathing until she almost passed out. He eventually handcuffed her. Sergeant John Egan and other officers arrived on the scene during the attack or the arrest, but did nothing to intervene. At the precinct, she was locked up for a couple of hours before taken to the hospital for treatment of injuries sustained from Officer Brown's attack. She was falsely charged with obstructing government administration and resisting arrest.
