Zambrano began to search Plaintiff while still jamming and bending Plaintiff's wrist back. Plaintiff felt the search was unreasonably intrusive about his testicles and informed Det. Zambrano the same. Plaintiff in no way resisted, attempted to flee, or attempted to injury the POs. Regardless Det. Zambrano intentionally slammed his open hand into Plaintiff's testicles three times with full force while continuing to jam Plaintiff's wrist. After being assaulted in the testicles three times Plaintiff got dizzy and fell onto the car he was being held against, breaking the passenger-side mirror with his chest. \n\nPlaintiff fell to the ground, still handcuffed. POs discovered what they knew to be a legal knife on Plaintiff. Plaintiff was put into a police vehicle, where a PO informed other POs Plaintiff did not fit the profile of a man for whom the POs were looking. Nevertheless Plaintiff was taken to the 79th Precinct where he was criminally processed. POs eventually took Plaintiff to the hospital for injuries to his wrist, chest, and testicles. Plaintiff's testicles alternated between numbness, tingling, sharp pain, and excruciating dull pain for days after the arrest, and still has frequent numbness in his right hand and fingers. Plaintiff was in unlawful custody for two days before seeing a job and was charged with criminal possession of a weapon based on Det. Zambrano's false report. The District Attorney's office dropped all charges against Plaintiff. In the process of conducting the raid that led to the arrests of Plaintiffs, Defendant Officers cursed at and tightly handcuffed Sharon, whereas they knocked Shamarlon unconscious knocking open her door before, upon her regaining consciousness, ordering her into the living room and also tighly handcuffing her. Plaintiffs were thereafter booked at the precinct, where defendant officers denied the plaintiffs access to medication, food and drink, as well as contact and visitation by friends and family. While plaintiffs were awaiting arraignment, defendant officers met with prosecutors and falsely stated to the prosecutors, among other things, that plaintiffs were in possession of drug paraphernalia and/or sold drug paraphernalia. Prosecutors declined to prosecute Shamarlon. As he approached his house. the plaintiff was approached by defendants. The defendants grabbed Mr. Holiday by his throat, threw him to the ground, and proceeded to assault him. The plaintiff had committed no criminal activity, nor did the defendants have probable cause or reasonable suspicion that plaintiff had committed any criminal activity. Mr. Holiday did not attempt to resist arrest, nor to assault the defendants in any way. The defendants struck plaintiff with their fists and kicked him repeatedly for several minutes. When the defendants finally ceased the assault, and began to taunt plaintiff. Defendants made jokes about how much blood plaintiff had lost. Following the assault, the plaintiff’s need for medical attention was apparent, however defendants did not take any steps to obtain medical attention for Mr. Holiday. Defendants entered plaintiffs’ home without a valid warrant, consent, or other legal basis to enter their home. Plaintiff Mrs. Holiday who is Mr. Holiday's mother objected to the officer's presence in her home. She was detained for the duration of the officer's search of her home. After not finding any contraband, defendants left plaintiffs' home and brought Mr. Holiday to the precinct. Mr. Holiday was treated at Woodhull hospital for serious injuries including fractures to his 8th, 9th, 10th, 11th and 12th ribs, subconjunctival hemorrhages causing him to bleed from both eyes, swelling to both eyes, head trauma, and numerous cuts and bruises. The plaintiff remained at the hospital for approximately four days. Based on the false allegations made by defendants, Mr. Holiday was charged with petit larceny, possession of stolen property, assault in the third degree, resisting arrest, criminal possession of a weapon, and harassment in the second degree. Mr. Holiday was arraigned and assigned $500 bail. All charges against Mr. Holiday were later dismissed.
