In response to that report, Defendants knocked on Plaintiffs' door without a search warrant; their visit proved the accusations to be false.\n\nDespite that, Defendant Zerafa provided false statements before a magistrate and was issued a search warrant. Operating under the authority of that warrant, Defendants returned to Plaintiffs' apartment and again found no evidence of the accusations. Plaintiffs were nonetheless arrested and imprisoned on false charges of sex trafficking, assault and endangering the welfare of their infant child. After entering the premises by breaking down the door, one NYPD officer came straight at plaintiff and punched him in the face and threw him to the floor. The same officer kicked plaintiff, grabbed plaintiff by the genitals, handcuffed plaintiff, and took money from plaintiff that he did not voucher. Another officer laughed at plaintiff and kicked plaintiff. Plaintiff was physically injured as a result of this unprovoked attack, including facial fractures. The police left plaintiff lying on the floor in his own blood until paramedics arrived to treat his injuries. The paramedics transported plaintiff to Elmhurst Medical Center Hospital where he received limited medical treatment, before being transported to the 115th Precinct where the police processed his arrest. Eventually, the police transported plaintiff to Central Booking for arraignment, and he was released. After his release, plaintiff received further medical treatment.
