In retaliation, Karambelas spent hours with NYPD officer defendant Marcos Martinez and other John / Jane Does officers developing a story to charge Kaplan with crimes allegedly committed days and weeks earlier. Karambelas had a previous history of making false allegations against her husband. That evening, SWAT Team officers pushed into Kaplan's apartment without his consent and ransacked it looking for weapons, removing a gold Rolex watch that was never returned to the plaintiff. During the search plaintiff was handcuffed with cuffs that were too tight and taken outside in view of his neighbors. The officers did not allow him to retrieve his eyeglasses or medication from the apartment. No weapons were found, but the officers arrested Kaplan for, among other charges, Criminal Possession of a Weapon in the Fourth Degree.\n\nWhile in Central Booking, plaintiff's physical condition deteriorated because he did not have his glasses or medication and Defendant Martinez and ADA Frankel falsely claimed he was in possession of a handgun, which led to an improperly high bail. Other inmates repeatedly stole his clothing, despite his complaints to the officers in the jail. On his second day of incarceration, paramedics were summoned to the jail to assist Kaplan with his irregular heartbeats. At that time, Kaplan was sprayed with nitroglycerin. causing muscle spasms and further lowering his blood pressure.  On his last night of incarceration, Kaplan was brought to a holding cell. While there, other inmates held him down and sexually assaulted him. Prior to this, Kaplan had repeatedly complained to officers about the abuse from other prisoners and requested protective custody.
