The officers, in particular, David Pabon, forced Plaintiff to stand in front of the female holding cell and conducted an unlawful strip search, where he sexually assaulted and abused Plaintiff by opening Plaintiffs’s pants, sticking his hand inside Plaintiff’s boxers, and fondling and squeezing Plaintiff’s testicles and penis.  The officers, in particular, David Pabon, failed to disclose and report and covered up such abuse and assault.\n\nOn or around November 18, 2020, Plaintiff was falsely arrested by Detective Jason Vasquez and was charged with Criminal Possession of a Controlled Substance in the Seventh Degree. However, Plaintiff did not possess or attempt to possess a Controlled Substance. Instead, the officers deliberately planted envelopes containing substance, which allegedly was heroin, on Plaintiff. The officers knew so but nonetheless charged him with the crime to conceal their own unlawful and grossly improper use of force and in retaliation as a result of Plaintiff complaining about their prior abusive, sexual assault, and improper acts. The officers, in particular, Jason Vasquez and David Demelia, submitted false and misleading police reports and statements to the DA’s office. In the month prior to the raid, Sebastian filmed police officers violently arresting a group of children outside of the complex, and subsequently filed a complaint with Internal Affairs. Sebastian’s brother, Manuel, was the victim of an errant bullet from gang crossfire. Manuel explained to police officers in the hospital that he had no involvement in any gang activity. When Manuel returned to the complex on May 20, he found officers harassing his brother Pablo for information about the shooting. Luz, Manuel’s mother, came out to protest the harassment as well, at which point Officer Taveras pulled out his gun, pointed it at Luz, and told her that the police knows where she lives. After Manuel refused to sign statements or medical releases, the NYPD opened an investigation into Luz’s apartment in order to obtain a search warrant. Detective Lopez and C.I. Roe provided false testimony to a judge, claiming that controlled drug buys took place at the Arbelaez apartment.\n\nOn the day of the raid, officers roughly handcuffed the Arbelaez family, placed them on the couch, and proceeded to harass them about drugs and denigrate the family home. Sebastian was afraid that the traumatic episode would send his epileptic mother into an episode, and he pleaded with officers to allow her to take medication. The officers laughed and asked if Luz needed methadone. Luz entered into an episode, shaking to the point she fell off the couch; at this point the officers allowed Luz to take her medication. The officers destroyed the apartment and the Arbelaez family’s possessions in their search for drugs, but found nothing.\n\nThe Arbelaez family was taken to the precinct, where they were charged with possession of cocaine and a scale. Luz was released from custody after several hours, while Sebastian and Pablo were transferred to central booking.
